本年度は、国内外の裁判例、法改正等の動向を踏まえつつ個別制度の検討を進めるとともに、海賊版対策の効果に関する従来研究を精査し2021年度以降の調査の実施のための基礎的な検討作業を重点的に行った。
日本国内の著作権法分野の動向については、令和2年(2020年)の著作権法改正によるリーチサイト規制の導入と私的使用目的でのダウンロードの違法化の拡大、音楽教室事件第一審判決等の侵害主体論の検討、リツイート事件最高裁判決の検討等を重点的に行い、その成果を論文等として公表した。特にリツイート事件最高裁判決については、2020年10月14日にオンラインシンポジウムを開催した。またその他の著作権法上の関連論点に関しても研究成果を公表している。また著作権法分野以外の動向も踏まえつつ、発信者情報開示制度の見直しやプラットフォーマー規制に関する検討も行った。
海外の議論状況については、欧州の単一市場著作権指令や侵害主体に関する裁判例の検討、米国著作権法512条によるオンラインプロバイダの責任制限に関する議会報告書等についての検討行った。米国におけるデジタルミレニアム著作権法によるプロバイダ著作権法関係の他、ネット上の名誉毀損を巡る状況等も踏まえつつ、発信者情報開示制度についての検討を行った。
実証研究に関しては、サイトブロッキングの効果に関する先行研究等を精査した上で、日本の状況について、漫画村等の社会問題化・摘発や2020年の著作権法改正等の海賊版対策のがユーザーの行動にどのように影響を及ぼしたのかについての調査を実施することとした。 -

In this study, we empirically examine the impact of patenting in SMEs on financing and performance. We find that patenting by SMEs increase their accessibility to venture capital funding relative to firms that do not, and also improve firm performance. The results also show that the expansion of the scope of software patents and the patent fee reduction schemes also play a significant contribution to the performance of SMEs in Japan.

In recent years, open innovation (OI) has attracted much attention from business practitioners and a lot of studies have been accumulated in the field of innovation management. Among these studies, however, the number of the studies that focus on outbound OI activities is rather limited. Our study focused on the outbound OI activities, especially on revealing of technological knowledge, and explored the effect on acquisition of external knowledge and information and the impact on innovation performance of the firm through qualitative as well as quantitative analyses. With these studies, we aimed to make a theoretical and empirical contribution concerning open innovation and induced practical implications for business practitioners.

We examine productivity of organization, focusing on inter-inventor collaboration network as a new bond of different knowledge and driver of innovation. Especially, we focus on inventor’s mobility across organizations which is supposed to change inter-inventor network. We found that most inventors move to organization within the same firm, between firms which have shareholding relations or transaction relations. Further, we found that such inter-firm relations causes better performance and knowledge of new technology propagate rapidly to organization with more mobile inventors and more experiences of collaboration.

With the introduction of the pre-grant publication system in Japan and US as natural experiments, this research project has found that the pre-grant publication not only increased the speed of knowledge diffusion from the invention, but also enhanced the first mover advantage of the disclosed invention on average. Also, we analyzed the effect of the introduction of the mandatory disclosure of prior arts in Japan in 2002, and found that the quality of disclosure improved, with the effect of shortening the examination period, and that the predictive power of inventor citations with respect to the patent value also increased. Consistent with these results, we also found that the extent to which the patent examination reduces the scope of the patent is greater as the applicant's disclosure quality is lower. In addition, we obtained new findings on the inventor's ability to absorb knowledge, the information constraint on the Patent Office, and the knowledge flow effect of grace period.

Open innovation, a collaborative innovation process with external companies and organizations, has been attracting great attentions from academic researchers as well as business practitioners. In this study, we tried to clarify the reality of such open innovation activity of Japanese companies in comparison with US and European counterparts and to explore when and how it leads high innovation performance. In the analysis, we paid attention to the interaction of inbound and outbound process of open innovation, the role of affiliated company which can be interpreted as an intermediate organization between inside and outside the company, the balance between internal and external technology sourcing for product innovation, and so on. Exploring these issues which have not been examined enough in previous studies is expected to be an originality of our study.
