    考察の対象時期は五世紀半ば以降から十世紀半ばにまで及が、理由は氏姓制が慣習法として長期にわたって息づいていたためである。では、なぜ氏姓制が長期間存続しているのか、という点が大きな課題となる。氏姓制は、律令性を導入する前代では政事構造の一翼を担い、その表示機能は大多数の人、いわゆる臣下臣民の公民層全体をカバーするものであり、その意義も律令制下よりも導入前においてより明瞭に現われており、まとめると3点があげられる。１中国皇帝や朝鮮諸王と異なり日本の天皇（大王）と賤身分は氏姓を有さないということ。２天皇が、氏姓の賜与貶奪権を有し、政事行為として賜与貶奪権を行う点。３氏姓が名負の職掌を表示し、その格を表している点。

    貞観年間（八五九～八七六）頃に成立し、惟宗朝臣直本編と見なされてきた『令集解』には様々な明法家の令解釈がまとめられている。これまでにも『令集解』そのものに限らず、引載された明法家についての研究もそれぞれ蓄積されている。明法家諸説に関する研究の論点には、その説が誰のものなのか、その成立はいつか、特徴はどのようなものか、といった点が挙げられる。本稿では、このような視点で研究されてきた諸説の中でも、近年扱われることが少なくなった「跡記」を中心に再検討を試みるものである。一「足云」の存否をめぐって 跡記を考察する前に、あまり気づかれていないが一つの問題がある。国史大系ではほとんど跡記に意改されてしまう「足云」について、これが跡記の「跡云」と同一なのか別注釈なのかというものである。

    日本古代の氏姓制や氏族の考察をする上での基本文献である『新撰姓氏録』については、田中卓や佐伯有清を中心に進められ、すでに多くの研究が積み重ねられている。また、いわゆる「帰化渡来系氏族」に関する考察にも、多くの優れた論考を見ることが出来る。さらに、同祖同族関係を主題にした分野でも、個別氏族を中心にした研究ではあるが、一定の成果が上がっている。しかしながら、これらを有機的に関連づけて考察された論考は少ない。最近、菅澤庸子は『姓氏録』を帰化渡来系氏族の縦（祖）と横（同族）の繋がりを再確認させるものと指摘している。一部の結論については首肯できるが、納得できない点も多い。

    本論は、日本古代の氏姓制を考察する上での重要な文献である『新撰姓氏録』を素材にしたものである。そこから抽出することは、その当時の「氏」の同祖同族関係の形態であり、この関係は日本の「氏」が政治的な団体であることによる、日本独自の特質である。論を進めるに際しては、『新撰姓氏録』の記載順序に基づいて、皇別氏族・神別氏族（天神・天孫系）・神別氏族（地祇系）に分割して考察を行った。また、同祖同族関係によって結びついている氏族数が多い事例に関しては、別個に図として論文末尾に付すことにした。この考察と図化によって得られた結果として、皇別・神別の区別無く、「氏」が氏族の集合体であり、各氏族は、最も勢力・政治的地歩がある本宗氏に収斂している従属的な関係であったことを示すことが出来た。

    This research project of compiling electronic data compendium of pottery with ink inscription has made considerable contribution to the studies of ancient Japanese history because very few sources written on paper survive today. The newly added data in the past year consist of those with drawings from eight prefectures, including Shiga Prefecture, and those without drawings from six prefectures, including Aomori Prefecture. This completes the data base of the all 47 prefectures of Japan, which makes it possible for cross-regional comparison of all over Japan. Furthermore, the data compendium incorporates a bibliography of pottery with ink inscriptions, listing 2274 references. We have also switched a server to further enhance the security against virus and attacks from hackers.
