本年度は、国内外の裁判例、法改正等の動向を踏まえつつ個別制度の検討を進めるとともに、海賊版対策の効果に関する従来研究を精査し2021年度以降の調査の実施のための基礎的な検討作業を重点的に行った。
日本国内の著作権法分野の動向については、令和2年(2020年)の著作権法改正によるリーチサイト規制の導入と私的使用目的でのダウンロードの違法化の拡大、音楽教室事件第一審判決等の侵害主体論の検討、リツイート事件最高裁判決の検討等を重点的に行い、その成果を論文等として公表した。特にリツイート事件最高裁判決については、2020年10月14日にオンラインシンポジウムを開催した。またその他の著作権法上の関連論点に関しても研究成果を公表している。また著作権法分野以外の動向も踏まえつつ、発信者情報開示制度の見直しやプラットフォーマー規制に関する検討も行った。
海外の議論状況については、欧州の単一市場著作権指令や侵害主体に関する裁判例の検討、米国著作権法512条によるオンラインプロバイダの責任制限に関する議会報告書等についての検討行った。米国におけるデジタルミレニアム著作権法によるプロバイダ著作権法関係の他、ネット上の名誉毀損を巡る状況等も踏まえつつ、発信者情報開示制度についての検討を行った。
実証研究に関しては、サイトブロッキングの効果に関する先行研究等を精査した上で、日本の状況について、漫画村等の社会問題化・摘発や2020年の著作権法改正等の海賊版対策のがユーザーの行動にどのように影響を及ぼしたのかについての調査を実施することとした。
