１ 昨年度の研究活動は、各人の個別の研究活動のほか、次の３本柱で遂行した。①「不動産所有権の今日的課題」と題する私法学会シンポジウムの主催とその準備。②各研究班からの問題探索的報告。③外部研究者を招聘した研究会。
２ ①については、３回の準備研究会を経た上で上記のシンポジウムを開催した。６人の報告者（吉田、田高、武川、秋山、山城、吉井）と２人の司会（金山、森田）のすべてが、本科研の研究代表者および研究分担者である。不動産所有権に関する私法学会として最初の本格的シンポジウムであり、その理論的提言についても、今日的課題への対応についても、高い評価を得た。
３ ②は４回開催した。そこでは、財産管理班：高秀成（善管注意義務）、青木則幸（リバースモーゲージ）、「人」班：金山直樹「性行為と慰謝料」、平野裕之（有料老人ホーム入居契約）、山城一真（ケベック法にみる高齢者保護」、武川幸嗣（高齢社会における「人の法」）、秋山靖浩（居住・コミュニティの確保）、松尾弘（地域コミュニティとその財産）、吉井啓子（フランス・ベルギーのマンション法）、総論ユニット：吉田克己（総論的考察）の諸報告が行われた。
４ ③は、国内研究者について２回開催し、橋本佳幸（ＡＩ）（札幌で開催）、能見善久（奴隷解放）、木村和成（人格権論）の３本の報告を受けた。外国人研究者としては、フランスのリル都市圏の空き家対策関係の実務家を招聘したほか、ムスタファ・メキ教授（フランス：パリ第13大学）チームとの共同研究を行った。テーマは、「ＡＩと民事責任」（早稲田大学土田和博科研基盤Ａとの共催）および「公証制度の比較法的研究」である。サン・ポー教授（フランス：ボルドー大学）を招聘した人格権関係の２回の研究会を開催した。ドイツのフランツ・ホフマン教授を招聘しての研究会は、新型コロナウィルス感染拡大の影響で、延期となった。

This research was based on the results of surveys and studies of European and US law that have been carried out with the cooperation of researchers both in Japan and abroad. The aim of this research was two-folded.Firstly,we aimed to survey, study and conduct a comparative research of the actual state of
comdominium legislation and management in Eastern Asia (Korea,China,Taiwan and Japan), again with the cooperation of researchers in Japan and abrord. Secondly, we aimed to make legislative and policy recommendations, from an academic standpoint, on the measures for condominium security and against condominium aging, as weii as the way of management required to achieve them. As a result of this research, we expressed the opinion that the remodeling being discussed in the legislative process in Korea and the dissolution system which has been legislated to a limited extent in Japan, should become the basis of condominium legislation. -

The purpose of this research project is, first of all, to establish a general theory of property law by putting as keywords the diversification of property, the diversification of relations of belonging and the relaxation of the law of property. As a result of research, we were able to publish a collective work in which all members of the research team participated. We also organized a symposium within the association of Japanese civilians to have our theses examined in this regard. During this research, the problem of unknown landowners has become an urgent social problem. So we have actively addressed this problem and published many articles.
Secondly, this research project aims to write a draft of the property law reform of the Civil Code on the basis of the general theory indicated above. We conducted four rounds of review work to formulate this draft. The work is now almost done and the results will be published soon. -

This research has examined the legal systems of foreign countries, has elucidated the issues of the Japanese legal system based on such examination and has made proposals for future legislations regarding the legal measures available for urgent issues in the Japanese condominium legal system, namely for the preservation and improvement of condominiums as well as for the deteriorating or disaster-stricken condominiums. The proposals made suggest that it is necessary to develop a legislation facilitating further reconstructions or dissolutions, and that on the other hand, since the number of such reconstructions and dissolutions is expected to be limited due to cost and other factors, it is also necessary to develop a legislation promoting preservation and improvement. The foreign legal systems examined by this research were those of Germany, France, the United Kingdom, the United States of America, Austria, Belgium, Switzerland, Greece and other countries.

This research groupe is organized by researchers who have published important papers concerning French property law. This reserch examined drafts of reforms to the Law of Property of The Henri Capitant Association of Friends of French Legal Culture and proposed the theoretical foundation for the systematic property law that is reformed to be suitable for the highly urbanized and industrialized society. Our society is confronting to the diversification of propery and of relation between properties and subjects, or legal entities and there is many problems concerning to this phenomenon. Moreover, our reserch groupe made mutual dialogs with the french reserc h groupe. As a result, our reserch groupe clarified actual conditions of French property law and Japanese property law, and extracted tasks to be resolved. Then, our reserch groupe made preparations for the reforming Japanese property law.
