本年度は、国内外の裁判例、法改正等の動向を踏まえつつ個別制度の検討を進めるとともに、海賊版対策の効果に関する従来研究を精査し2021年度以降の調査の実施のための基礎的な検討作業を重点的に行った。
日本国内の著作権法分野の動向については、令和2年(2020年)の著作権法改正によるリーチサイト規制の導入と私的使用目的でのダウンロードの違法化の拡大、音楽教室事件第一審判決等の侵害主体論の検討、リツイート事件最高裁判決の検討等を重点的に行い、その成果を論文等として公表した。特にリツイート事件最高裁判決については、2020年10月14日にオンラインシンポジウムを開催した。またその他の著作権法上の関連論点に関しても研究成果を公表している。また著作権法分野以外の動向も踏まえつつ、発信者情報開示制度の見直しやプラットフォーマー規制に関する検討も行った。
海外の議論状況については、欧州の単一市場著作権指令や侵害主体に関する裁判例の検討、米国著作権法512条によるオンラインプロバイダの責任制限に関する議会報告書等についての検討行った。米国におけるデジタルミレニアム著作権法によるプロバイダ著作権法関係の他、ネット上の名誉毀損を巡る状況等も踏まえつつ、発信者情報開示制度についての検討を行った。
実証研究に関しては、サイトブロッキングの効果に関する先行研究等を精査した上で、日本の状況について、漫画村等の社会問題化・摘発や2020年の著作権法改正等の海賊版対策のがユーザーの行動にどのように影響を及ぼしたのかについての調査を実施することとした。 -

著作権・商標権侵害に基づく損害賠償額の実証・比較分析：TPP後に向けて

特許法分野での裁判例・法改正の動向を踏まえつつ、著作権・商標権の損害賠償額に関する裁判例について、著作物の利用や商標の使用が需要者による被告製品への購買行動についてどのような影響を及ぼしたか（侵害がなければ権利者製品を購入したといえるか、権利者製品を購入したといえる場合にも、当該著作物の利用等が購買動機の形成においてどのような役割を果たしたのか）という観点から精査する作業を行った。
具体的な成果として、2020年度の検討内容に基づく特許法関係の大合議判決の判例評釈・論文を公表した他、特に、侵害品とは別途購入される関連製品・サービスに関する裁判例についての判例評釈を公表した他、平成30年改正後の著作権法114条4項の適用を認めなかった裁判例についての検討を行った。
近時の特許法分野での損害賠償を巡る議論動向（裁判例や法改正の他、近時の利得吐き出し型を志向する特許法102条2項の解釈の有力化等）につき2022年2月16日のRCLIP特許権行使戦略セミナーで報告し、これについての議論を行った。この議論の成果は著作権法・商標法分野での検討に反映する予定である。
また米国著作権法・商標法について、損害賠償等に関するデータベースを活用し、日本法との比較を進めるとともに、商標権侵害に係る利益返還に関して故意を必須の要件としないとした2020年のRomaq対Fossil事件連邦最高裁判決に関する検討等を重点的に行った。 -

The outcomes of this study are to clarify the significance of discussing the role of the Constitution and its constitutional value in the field of intellectual property law, and to examine and make recommendations on specific issues such as parody, site blocking, the patent system and public health, and requirements for trademark registration and freedom of expression, as well as the division of roles between the legislative body and the courts. The results were published in the form of books and academic papers such as "Intellectual Property and Constitutional Values" (published by Yuhikaku in January 2022).

We performed the study about the relations with the mark protection system and "the non-economic public interest" such as an environmental problem, public sanitation, the geographical indication.
Specifically, we performed the study about relations with the mark protection and environmental protection, public sanitation, public order and morals, freedom of expression, it including the research the system and judgment of foreign countries and performed the examination about the way of the mark protection which the relations with the public policy considered.
In addition, we performed the study about about the new protection system of the geographical indication of farm products and the new types trademark protection such as a sound, color etc, we performed the examination about the significance of the system and the problem in the legislation and practice. -

Japanese Copyright Act is too rigid to adjust the interests of the creators, authors, publishers, and users. Therefore we show some proposals about legislation and construction of copyright law and provide some empirical studies and theological analysis in our book “Toward a Flexible Copyright System (Shinayakana Chosakuken Seidoni mukete)”.
In addition, we held four symposia about current copyright issues, offered a proposal about rights of publishers, and issued a joint statement about criminal enforcement and copyright law. -

Patent law pursues the “development” as its objective. In recent years, however, we have seen many multilateral disputes in which various values?environmental protection, public health, bioethics and so forth?public policy seeks to achieve have come into conflict with patent law objectives. Our research project was structured in two phases. In Phase I, we collected and analyzed information for each topic. Keeping in mind synthesizing our findings in Phase I, we held an international symposium on patents and bioethics/medicine and a policy discussion on patent-related issues of environment and development in Phase II. We made it clear that those problems should be comprehensively treated as an issue related to patents and non-economic values,and that policy making process should be made open, flexible and horizontal.
