＜判批＞１ 中学校におけるいじめによって自殺した亡生徒の自殺に係る損害につき、いじめ行為から「通常生ずべき損害」に当たるとして、いじめ行為との相当因果関係を認めた事例 ２ いじめによる自殺に係る損害賠償額につき、亡生徒は自らの意思で自殺を選択し、さらに金銭窃取という違法行為により自らを逃げ場のない状態に追い込んだという点で、両親も家庭環境を適切に整えることができず、亡生徒を精神的に支えることができなかったという点で、過失相殺の適用及び類推適用を基礎づける事情があると認定し、４割を減額した事例
