    This paper examines the responsibility and control of social media platforms from a constitutional law perspective using U.S. Supreme Court precedents. The U.S. Supreme Court has employed the common law approach of identifying commonalities and differences between the case at hand and past precedents in developing the legal principles surrounding freedom of speech through accumulated precedents. The First Amendment to the U.S. Constitution guarantees freedom of religion and speech. Debates surrounding freedom of speech have been central to U.S. constitutional jurisprudence. The Supreme Court has ensured legal stability and predictability for "we the people" by demonstrating the methodology for interpreting freedom of speech laws through accumulated precedents.     Under the US Constitution, justices interpret and apply the law to cases and provide relief, and they are supposed to be responsible for legal judgments, free from political preferences. Recently, the US Supreme Court has been criticized for arbitrarily reflecting their own preferences in their interpretations of the Constitution and laws, and for destroying the Constitution. The judges are granted the authority to interpret the US Constitution and laws by the US Constitution, and they exercise this authority within the limits of their discretion. To prevent this authority from being exercised arbitrarily, there are several interpretation methods. The reason why the judges' decisions are considered to be rational and not arbitrary is because of the reasoning behind their decisions.

    This paper clarifies that when Japanese constitutional and administrative law scholarship references debates surrounding American textualism, it must note that American constitutional scholarship has debated the limits of interpretation permitted under the premise of fidelity to the text of the law. When exercising the interpretive authority granted by the U.S. Constitution to the U.S. Supreme Court, demonstrating the validity and rationality of legal interpretation can secure public acceptance and trust. Such interpretation is not necessarily confined solely to “judgments.” The authority granted by the U.S. Constitution to the U.S. Supreme Court may be a “remedy” demonstrated through legal interpretation.

    This article critically analyses Japan’s evolving legal and regulatory framework for climate change adaptation, with a particular focus on land-use planning and the protection of cultural heritage. It argues that while Japan has made substantial progress inintegrating climate risk into national and local governance, significant gaps remain in aligning regulatory mechanisms with region-specific vulnerabilities. Drawing on a legal and policy-oriented analysis of statutes, regulatory instruments, and recent legislative amendments, the study examines how local governments employ hazard maps to visualise disaster risks and guide land-use decisions in areas increasingly affected by climate-induced natural hazards. The findings show that national assessments often lack the spatial and contextual precision required for effective local adaptation, leaving municipalities to develop their own risk governance mechanisms. In response to the rising frequency and intensity of climate-related disasters, legal reforms have strengthened the statutory basis for integrating disaster prevention with cultural heritage protection. The case of Kyoto, with its concentration of World Heritage sites, illustrates how local authorities have combined zoning regulations, heritage preservation laws, and disaster risk management frameworks to enhance climate resilience.

    This paper examines negotiated rulemaking and advisory committees in the
    United States from the perspective of Japanese constitutional law. There are pros
    and cons in evaluating negotiated rulemaking procedures. By using negotiation,
    stakeholders, especially regulated parties, may view the opportunity to be involved in
    rulemaking favorably and may be willing to submit scientific data and move to comply
    with the rules. In environmental regulation, it has been pointed out that regulated
    parties do not comply with regulations even when strict regulations are prepared
    because of the manpower, time, and money constraints of the regulations, which
    involve sanctions. In terms of encouraging compliance with regulations, negotiated
    rulemaking has certain merits.
    Negotiated rulemaking in the U.S. seems to appear in Japan in situations where
    the status of a council is under review. The risk exists that a council is used to justify
    a particular policy. In response to the evaluation that a council exists as if it were an
    endorsement of a specific government policy, it is necessary to separately examine the
    constitutional academic freedom of researchers and the state of mass media coverage.

    "At the very least, this strategy shows that, firstly, the multiplicity of policies makes it difficult to see the means of achieving specific goals. The National Diet and government ministries and agencies work to enact laws on the assumption that they are constitutional. Generally, the courts would not be confused by an review of the purpose of a law. There is a presumption of causality between the end of a policy and the means of achieving it. However, if the law has multiple purposes, the court will intepret each of these purposes separately when examining the constitutionality of the law, and in some cases it may even find hidden purposes, and then it will rigorously review whether these were the genuine purposes of the legislature. If the ends are too abstract, it may even require each party to make them more concrete at the stage of reviewing the means. In reality, the objectives written in the law, such as 'culture' and 'landscape', should not be valued too low, and it is difficult to assess the degree of achievement in the context of policy evaluation. Laws can have an impact beyond their stated objectives."

    This manuscript is a revision of the paper based on a lecture for Algerian civil servants given in December 2024 at the request of the JICA. This study examines administrative authority and policy-making by public officials from a constitutional law perspective (especially that of the Japanese Constitution); building on existing research in public administration and political science. In Chapter 1, we evaluate the administrative reforms of the 1990s; and in Chapter 2, we provide an overview of the current government structure. In Chapters 3 and 4, this paper will examine policymaking from the perspective of the constitution and administrative law, with the help of research into public administration. In Chapter 5, I will introduce the types and numbers of public servants, as well as the National Personnel Authority and its examinations. In Chapter 6, I will examine the phenomenon of the Prime Minister’s use of his authority to appoint public officials to positions of responsibility; where the expertise of the bureaucrats is not reflected in policy formation, and their initiative is subordinate to that of the Prime Minister, through examples.

    Japan’s challenge will be how quickly it can shift its energy supply to renewable energy sources. To increase energy self-sufficiency and defense power, Japan should promote policies that encourage renewable energy use. However, under the current legal system, local governments are not involved in the legal review process for establishing nuclear power plants. Through agreements, local consent is required to restart a plant. However, this is merely a contract, and permission is granted even if the agreement is violated, as long as the plant passes a safety review. The central government is trying to facilitate communication between local governments and operators, but it is not enough. Legally requiring the establishment and funding of councils would stimulate local discussion and support local actors who file civil or administrative lawsuits if the power company’s explanation is insufficient.

    気候政策主導のエネルギー部門の変革のプロセスは、国内外の法的枠組みの変更を加速させている。しかし、公正なエネルギー転換を成功させるには、大幅な規制改革が不可欠である。そこで本稿では、気候変動目標を達成し、大気中への人為的温室効果ガス排出量を削減するために、公正なエネルギー転換を保証する規制ツールの修正・導入の可能性について検討する。この分析は、エネルギー正義の理論と、その5つの主要な柱である「承認的正義」「手続き的正義」「分配的正義」「修復的正義」「コスモポリタン的正義」の適用に基づいている。これら5つの領域それぞれについて、制度的・意思決定的側面から、追求・計画されているエネルギー政策を強化できる規制手段を提案している。この結論は、エネルギー政策の計画・実施方法には根本的な変革が必要であり、その規制手段はエネルギー正義の要件を満たすように修正されなければならないということである。その結果、本稿で提案するのは、エネルギー移行プロセスをより公正なものにする努力の前進とみなすべき、さまざまな法体系におけるエネルギー正義を制度化する普遍的な方策である。

    This article examines COVID-19 vaccination in Japan and possible compensation
    rights for those who experience adverse reactions. In Japan, the Constitution1 and
    the Local Autonomy Act2 place regular vaccination of citizens as a municipal task.
    If a disaster occurs that is beyond the jurisdiction of the municipality, the
    prefectural government, which is positioned above the municipality, responds. The
    central government is constitutionally responsible for coordinating prefectures in
    the event of a disaster that exceeds their capacity to handle.

    This manuscript examines how Marbury v. Madison influences the Japanese Constitution and the Administrative Case Litigation Act. The missing lesson of Marbury v. Madison in Japan is the fact that judicial review,
    which is not explicitly mentioned in the U.S. Constitution, is a creation of the judicial branch born out of Marbury v. Madison, and that the case was based on a dispute between the old and new Presidents. The 2004 amendments to
    the Administrative Case Law Act were expected by the Parliament to stop the executive branch. This makes it clear that the mandate of judicial review is not only to guarantee private rights, but also to realize the public interest.     This paper elucidates the actions of the Japanese government against COVID-19 during the first five months of 2020. On May 25, 2020, the government lifted the emergency declaration passed under the amended Influenza Special Measure Act (ISMA).
    This paper argues that the experience of Japanese government action is not unique, but similar to those of other countries. In February 2020, the Japanese government had passed ISMA against severe acute respiratory syndrome (SARS), not COVID-19. The Government hesitated to use ISMA against COVID-19 for political reasons. The government opened advisory boards and chose policy judgment. If a delay in governmental actions led to an increase in the number of serious patients, the governmental inaction was subjected to the State Redress Act and people will change the government in the next election....

    Japanese administrative agencies are authorized to exercise discretion within the scope of power vested in them by the statutes passed in the parliament, or Diet. Under the Administrative Case Litigation Act (ACLA), which was revised in 2004, Japanese courts can review potential unlawful use of government authority under several principles such as fact-finding, purpose, timing, equal principles, constitutional rights infringement, and unconstitutional motives. The judiciary has reviewed administrative agencies' decision under ACLA in nuclear power plant cases. Under ACLA, Japanese courts can review if the administrative discretion of administrative agencies is arbitrary and capricious, but not their political validity and policy judgment capability. The judiciary may defer to administrative agency decisions in light of their expertise. In any review of administrative discretion, the court may take the position of the administrative agency to review the latter's disposition. In other cases, the court may respect the agency's disposition and review only the procedure.     This paper reviews an adaptation plan for the Tokyo Metropolitan
    Area. The Japanese Government decided to remain in the Paris
    Agreement and began trying to reduce CO2 with technology after the
    Great East Japan Earthquake of 2011. Nuclear power plants were closed,
    and some are still under safety review. Newly built thermal power plants
    will increase CO2 emissions, and the battle among the ministries hinders
    effective adaptation planning.

    With the increasing globalization of politics, culture, and the law,
    the scope of sovereignty has narrowed. Over time, people became
    increasingly indifferent to politics. Thus, direct democracy may be a
    good method for connecting voters with politics. Popular sovereignty
    is the principle that authority and power reside with the people.
    Legitimacy is given to representatives who are expected to work for all
    of the people once elected. Representatives are expected to reflect the
    peoples’ diverse perspectives in the parliament and integrate them into
    the law. Japanese constitutional studies examine how to assure that the
    people’s diverse voice reaches the parliament and how to allocate the
    parliamentary seats to adequately reflect the people’s vote. When the
    Japanese Constitution was established, it cemented constituent power
    as the power to amend, meaning it can be activated only when the
    people amend the constitution directly. However, the Constitution
    provided a few exceptions such as power to amend the constitution and
    power to enact special laws applicable to the local governments.
    Mostly, however, only representatives actively participate in politics.

    This principle of judicial independence is also true of the Japanese judiciary. The Japanese judiciary and constitutional scholars have incorporated US legal studies and have developed skills of legal interpretation to maintain the independence of the judiciary. Not only the judicial branch, but the individual judges are also independent and are bound to the law and their professional conscience. Urawa and Naganuma cases present some cases that suspect that the Japanese judiciary and individual judges have been influenced by political considerations. Other cases such as judge Miyamoto case in Chapter 3 have suggested that the office of the Japanese Supreme Court may have an impact on individual judges.

    n 2016, the Japanese Supreme Court apologized for establishing a special tribunal for leprosy patients outside a standard courtroom. The Supreme Court initially admitted that the special tribunal was unconstitutional because the unfair procedure and trials discriminated against leprosy patients. The Supreme Court’s decision to establish exceptional courts at the time was not based on scientific research regarding leprosy. These patients were isolated in sanatoriums until 1996, when Parliament abolished the Leprosy Prevention Law. Then, in 2001, the Kumamoto district court accepted governmental responsibility for the legislative inaction that led to the government’s compulsory isolation policy. The Kumamoto court noted that the statute of limitations started in 2001, when the legislature abolished the Leprosy Prevention Law.

    Approximately seventy years have passed since the establishment of the Japanese Constitution. After obtaining majority seats in the House of Representatives in 2016, the coalition government started discussing an amendment to the Constitution. If these discussions are fruitful, it would be the first time in history that the Constitution is amended.

    Several proposals have been made to amend the Constitution; one is concerned with emphasizing public interest by unifying the people. This Article: first reviews the proposed amendments to the Japanese Constitution drafted by the Liberal Democratic Party (LDP) in 2012.

    Next, this Article: analyzes the academic theories concerning public welfare under the current Constitution. Japanese constitutional scholars have persistently studied the concept of public welfare. Some scholars believe the word "liberty" is associated with the equal treatment of people irrespective of their life choices, while others interpret it as condoning selfishness. The theories of American philosophers John Rawls and Michael Sandel may help inform our understanding of the Japanese Constitution. Their theories are imported into Japanese constitutional studies to protect human rights under the rule of law. Japanese constitutional scholars, meanwhile, are afraid that the amendment proposals of political parties neglect human dignity in the name of public interest and drift toward totalitarianism.

    Third, this Article: reviews the term "public welfare" as it appeared in the amendment process of the current Constitution because the word lacked consistency in both intent and meaning in various articles of the Constitution. Finally, this Article: examines the role of the judiciary in effectuating the rule of law and protecting diversity. To this end, the Article: discusses several well-known decisions by the Japanese judiciary that demonstrate how vital the role of the judiciary is in protecting individual rights in order to unite people with different ideas, beliefs, and perspectives.

    The decision making of the Congress delayed the Clean Air Act. From Bush to Obama administration, EPA has changed its policy to deal with the global warming. MA v. EPA decision held that GHG is "air pollutant" in mobile source such as the automobile, and also that administrative agency has the authority to regulate it. EPA thought that the consistency of interpretation demands GHG from stationary source regulated. The burden to be implemented is so heavy that EPA prepared the coordinated regulation. In UARG decision, majority opinion delivered by Scalia gave up the consistency of the text of CAA as a whole and limited the meaning of pollutant narrowly. "Anyway source" with BACT regulation is still to be reviewed. 2014 decision allows EPA to regulate GHG in Clean Air Act without amendment by the Congress. The Obama administration proposed "Clean Action Plan". Because of the dubious breadth of the text of the statute, the administrative agency may fill up the blank by a technical interpretation of the regulations or policy decisions. The role of the court is to respect the order of administrative agency by "Chevron doctrine". EME Homer decision defers to technical and expertise judgement of the agency. The cost effective approach showed by the Supreme Court is still unclear and to be considered with other decisions and methods of interpretation by Justice of the Supreme Court. According to Prof. Dan Farber, the S.Ct has picked up the cases of which influence is too narrow. The effect on other similar cases is ordinarily limited. The inferior court decision would continue to supply the blank. Roberts Court could have avoided the cases by standing doctrine. By applying the second phase of Chevron doctrine, Roberts Court proceed on the merit. In 2014 Scalia approach was stuck, in EPA v. Michigan is pulled punch to the environmentalism. The duty of Constitutional law scholar is to show the inconsistency of text of the statutes showed by the Supreme Court. Not only order of the administrative agency, interpretation by the judges is under the rule of law.

    The Fourth Amendment was added to the U.S. Constitution in 1791. In no place in the Fourth Amendment does the term “warrant” appear. In interpretation of the Fourth Amendment by the U.S. Supreme Court, the police require warrants to perform searches. A warrantless search is deemed reasonable only if it falls within a specific exception to the Fourth Amendment&#039;s warrant requirement. <br />
    The ninety percent of American adults who own cellphones todays carry with them digital records of nearly every aspect of their lives. Two hundred and twenty-three years have passed since the Fourth Amendment was added. In Riley v. California, the Supreme Court held that the police generally have no authorization to search digital information on cellphones seized from arrested individuals without warrants. <br />
    While the Riley case is certain to be a subject further study, the American scholars who have studied the case so far have found several lessons for the interpretation of constitutional law. <br />
    In this article, I would like to discuss this issue with a focus on the interpretation methods of the originalist Justice Scalia and the intra-textualist Akhil Amar, and the battle between Congress and the judicial approach. Justice Breyer provided six factors to overturn precedents. Daniel Farber shows a pragmatic approach.

    シティズンユナイテッド判決ではスティーブンズ裁判官が長大な反対意見を執筆して引退した。スティーブンズ裁判官によれば、選挙規制の目的は選挙の腐敗あるいは候補者と企業との密接な結びつきによる腐敗の様相であることをオースティン判決とマコネル判決は疑っていなかった。シティズンユナイテッド判決法廷意見は、企業という属性で表現の自由に制約の差を設けることは違憲である と判断した。シティズンユナイテッド判決の表現の自由に対する影響力は大きいが、その射程については争いがあった。バックレー判決をシティズンユナイテッド判決同様に、今回のバロック判決でも誇大に評価したという批判もありえる。シティズンユナイテッド判決が今後の表現の自由を左右する一般的な判決かどうか、あるいは個別案件に限定される判決かどうか判決直後は不透明であった。シティズンユナイテッド判決の直後のアリゾナフリースピーチ判決、スピーチナウ判決はシティズンユナイテッド判決の方向性をある程度、固定化したのかもしれない。二〇一二年の大統領選挙では、多額の資金が選挙活動に利用され、その総額を把握することも困難となった。平等という点から見た表現の自由の問題、また連邦主義という点から見た表現の自由の問題について、どうやらシティズンユナイテッド判決は支配的な判決であるとバロック判決の法定意見は考えたようである。ただし、これは選挙に関する規制に関する利害の調整の場として裁判所が選ばれるのは妥当か、あるいはもし選ばれた場合に適切に機能しているのか、という疑問が残る。

    In recent years, Japan has implemented a broadcasting satellite system, which transmits contents, like cable and internet. The internet is highly compatible with this new broadcasting system. Although Japan has yet to combine the internet with this new broadcasting system, the government is encouraging private developers to distribute the programs through the internet. However, the laws regarding broadcasting and telecommunication are separately regulated, and there is no comprehensive statute. Those dissatisfied with this system of laws might urge the Japanese Parliament to revise these statutes drastically or to pass a new statute to cover a new internet broadcast system. In the near future, if traditional terrestrial broadcast and internet communication converges on digital basis, it will be necessary to examine the use of judicial review and constitutional theory. That is to say, Japan needs guidelines for dealing with free speech and judicial review. The Supreme Court of Japan needs to consider the constitutionality of internet broadcasting in the context of free speech. U.S. Supreme Court cases and current arguments about constitutional theory in the U.S. provide Japan with a good suggestion. It is important to examine the constitutionality of the U.S. legal systems for such review since the U.S. has a significant impact on the Japanese legal system. It is possible that a foreign country's legal arguments might not work in Japan. However, there are already certain parts of the U.S. legal system that have worked in Japan, thus far. For example, public choice theory has recently arrived in Japan. Public choice theory explains the voters and politicians from economic theory. This may provide an alternative theory to explain the role of legislative process and judicial review in Japan's Constitutional law. This theory does not exclude other explanations, but simply provides an additional explanation of the Constitutional structure that other conventional theories can not explain well. Certainly this notion is needed to add some extra conditions in Japan because of its underlying deep theory. By carefully researching why American legal cases and theories that support free speech strongly and asking whether these models are truly feasible in Japan, it is possible to establish a new theory in Constitutional law in Japan. In essence, the Japanese constitutional law field, especially free speech, needs guidelines to navigate through the next century.

    The paper discusses Japan's legal and institutional reforms to comply with Article 6 of the Paris Agreement, which provides the legal basis for cooperative approaches to greenhouse gas mitigation. Japan has implemented several measures to enhance its carbon market mechanisms, including the Green Transformation Emissions Trading Scheme (GX-ETS) and the Joint Crediting Mechanism (JCM). The GX-ETS, launched in 2023, is a voluntary cap-and-trade system that will become mandatory in 2026. It aims to integrate carbon pricing into Japan's decarbonization strategy and balance emissions reductions with industrial competitiveness.

    The interpretation of the law is closely connected to the worldview of the person doing the interpretation. In the interpretation of the constitution, in particular, the worldview of the interpreter comes to the fore.The interpretation of the Constitution and the law is a tool used to defend the independence of the judiciary and its judges. These tools act like a defense mechanism that works like a strong wall against the intrusion of the other two political branches. As a result of language problems, judicial independence and the interpretation of Japanese law is not very well known outside Japan. Japanese scholars have imported US constitutional analysis into Japan and have carefully reviewed the mechanism to see whether it worked properly or not. The analysis of constitutional scholarship has brought forth a new dimension of the independence of the judiciary and individual judges.

    This paper aims to consider how we exercise constitutional rights under the rule of law and constitutionalism in Japan. Political parties in Japan belong to state and non-state spheres. Citizens can exercise their constitutional rights such as the right of petition, and freedom of expression to monitor the government.     In response to climate change, I am reviewing existing land use regulations in Japan. In order to prevent damage caused by unexpected disasters, local governments are compiling and publishing maps that visualize disaster risks and regulate land use in areas with high disaster risks. Several national-level research projects have conducted climate change impact assessments, but there is a lack of impact assessment information that reflects regional characteristics. Adaptation to climate change must reflect local conditions. I would like to discuss the Japanese example of cultural heritage being damaged by climate change. This paper uses a legal approach, and reviews statutes that protect cultural heritage from damage caused by natural disasters due to climate change. This paper reveals that natural disasters are occurring with far greater probability and extent than previously expected, and that several laws have been amended to prevent natural disaster losses. Furthermore, this will examine whether the example of Kyoto, which has protected cultural heritage sites such as World Heritage sites from various disasters, can be used by other local governments.

    The Supreme Court has ruled that a law requiring a person with gender identity disorder to undergo surgery to eliminate reproductive function in order to change the sex on his or her family register is unconstitutional.
    The special law governing the sex in the family register of persons with gender identity disorder permits a change of sex only if several requirements are met, including the absence of reproductive function and the appearance of genitalia similar to the sex after the change, which effectively requires surgery.
    The Supreme Court focused on three factors in the legislative process. The Supreme Court focused on three factors: changes in legislative facts, developments in medical knowledge, and the laws of other countries. These are the three factors that the Supreme Court, which has long been seen as passive in its constitutional review, is actively deciding.

    Since World War II, under the new constitution, the Japanese judiciary, through the accumulation of
    precedents, have come to examine with precision the grounds for regulating constitutional rights.
    In the cases accumulated in the postwar period, the duty that Japanese constitutional jurisprudence requires judges to perform is the task of weighing the extent to which the restriction of rights is necessary to realize the purpose of the law, the content and nature of the rights to be restricted, and the specific manner and extent of the restriction of rights. Nevertheless, there remain problems inherent in comparative balancing, namely the imprecision of standards and the wide discretion of judges.
    The German three-step review process of comparing the interests to be regulated with those to be restricted by the narrow principle of proportionality was introduced in Japan in conjunction with the U.S. constitutional review process of examining ends and means.

    his paper analyzes whether the government is obligated to compensate the business losses caused by the request for self-restraint order in Japan. Property right provision of the Constitution of Japan, requires specific damages for compensation. The Constitution believes that if burdens are widely and generally shared, then compensation should be shared among people, and compensation is unnecessary. If people change their minds about the fairness of compensating certain industries after discussing the nature of the special sacrifices, and if the perspective of society as a whole change, then parliament might create a provision to support the government in the Influenza Special Measure Act. This paper notes that compensation for property rights and financial support are two different issues. As a matter of policy, when the government supports the socio-economically vulnerable, it is not a matter of compensation for property rights, but a matter of social rights and a matter of policy.

    Climate change is a current and future concern, challenging us to mitigate or avoid its effects, and to best utilize its opportunities.
    Japan is a long archipelago, extending from north to south. The degrees of impact and temperature rise differ across its regions. As central and local governments cannot ignore the impact of climate change, they need to implement adaptive measures against it.
    Adaptation is to “prevent or reduce damage, and to contribute to a stable living environment, sound development of a society and economy, and to preserve the natural environment”.

    Adaptation is a long-term goal which requires perspective on how local durably shape their communities. First, this article reviews the Japanese Climate Change Adaptation Act, and second, it examines the Japanese Environmental Impact Assessment Act. Lastly, as a case study, wind power generation and its assessment are analyzed.

    This paper elucidates the actions of the Japanese government against COVID-19 during the first five months of 2020. On May 25, 2020, the government lifted the emergency declaration passed under the amended Influenza Special Measure Act (ISMA).
    This paper argues that the experience of Japanese government action is not unique, but similar to those of other countries. In February 2020, the Japanese government had passed ISMA against severe acute respiratory syndrome (SARS), not COVID-19. The Government hesitated to use ISMA against COVID-19 for political reasons. The government opened advisory boards and chose policy judgment. If a delay in governmental actions led to an increase in the number of serious patients, the governmental inaction was subjected to the State Redress Act and people will change the government in the next election.
    The emergence of COVID-19 has compelled Japanese scholars to question the validity of legal principles. Outside of Japan, the New York Times argues that the Japanese constitution should be amended to cope with such an emergency.
    This paper is vigilant of the governmental interventions that are carried out in the name of emergency and keeps legal principle under rule of law. An emergency does not allow us to ignore the law; nor does it put the administration above the law. If the emergency is predicted, we can prepare and prevent it with the use of law. If an emergency occurs, we can mitigate damages and recover quickly by interpreting or amending the existing statutes.
    The lessons from the actions undertaken by the Japanese government should be shared with other countries that have democratic constitutions. When we start a constitutional and administrative law analysis, the legal and political responsibilities should be distinguished

    This paper analyzes the concept of “national referendum” and the relationship between representatives and citizens in Japan. In Japan, there is no provision for a referendum in national level except by an amendment of the constitution, and a special statute in national parliament, which is applicable only at the local public entity level.
    As per Japanese constitutional studies, a national referendum on specific issues with binding power isn’t allowed but is permissible with no binding power. First, the constitution clearly declares that the law-making power lies exclusively with the parliament, the Diet. Further, representatives may abuse the outcome of a national referendum in the name of the people, by plebiscite. The Japanese constitution also does not permit a recall system to fire representatives of the parliament as there is no provision for it and representatives works for all the Japanese and is independent of voters in his electoral districts.
    In the Japanese constitution, popular sovereignty comprises the nation (Nation) and its people (peuple), a concept derived from the 1791 and the 1793 French constitution. The 1791 constitution is based on sovereignty and the 1793 constitution emphasizes the power of the voters in the sovereignty. Representatives, once chosen, work for all the people independent of the will of the electoral district in the name of “we, the people.”
    If a national referendum is allowed, the Japanese people may question the role of popular sovereignty, according to which, we, the people, decide our destiny and take all the responsibility even if our decisions are a mistake. In reality, however, ordinary people consider politics to be very far from their daily lives. These days very important decision is made by strong ruling party without deliberation and democracy is in crisis in Japan as well.
    Japanese constitutional scholars have proposed a semi-representative and sociologically representative form to connect politics with citizens. As per the semi-representative, the will of the representative should match that of the people, while as per the latter, the election legitimizes the representative and binds him or her, and that we, the people, choose a political party that reflects our beliefs through partisan distribution in the parliament. Both overlap and the Japanese constitution is in stage to reflect the will of the people to the parliament.

    This study examined how California's laws and policies influence other states and federal laws, and why California is able to develop pioneering strategies. Through this examination, we made specific recommendations for climate change law and policy in Japan. At first glance, California's efforts may seem to be unique to that state, but it shares the same concerns as Japan. We published Californian climate change law and policy in Japanese.

    Switzerland is known as a country that has always remained neutral. There are calls from both inside and outside the country to question Switzerland's neutrality in the wake of its response to Russia's invasion of Ukraine. There are also moves to amend the law so that weapons can be “re-exported” to Ukraine via a third country, even though Switzerland is not supposed to provide weapons to the parties to a conflict. In the first of two articles, we will look at why Switzerland is a neutral country and what this neutrality means.
