Profile

I was born in September 1976 in Yoshii Town (now: Takasaki City), Gunma Prefecture, JAPAN and lived there until graduating from high school. In 1995, I entered the School of Law Meiji University, and in my third year, I met Professor Michio Yamada and decided to pursue a career as a researcher. After working for four years at the Faculty of Economics at Toyama University, I transferred to the School of Law Meiji University, where I have been working ever since.

     My strong interest in complaints and crimes requiring complaints, which would become my lifelong research theme, began when I encountered the 1995 amendment to the Penal Code (simplification) in a general criminal law class during my first year of university. The biggest turning point in my research career was the two years I spent abroad at the University of Augsburg in Germany.

    This paper reviews the German Third Reform Act on Victims' Rights of 2015, which was enacted under the influence of the Directive 2012/29/EU of the European Parliament and of the Council of 25 October 2012 establishing minimam standards on the rights, support and protection of victims of crime. The Act expanded the victims' right to obtain information and the protection of vitims and witnesses during examination, and made concrete provisions on the psychosocial escort etc. At the same time the Act on the psychosocial escort in criminal procedure was also enacted.

    In the early Meiji Era (1868-1890), the Kokuso (criminal complaint) functioned similar to complaints processed according to civil procedure. The Kokuso assumed a purely public function. However, the Kokuso can be considered a victim's right to seek an appropriate investigation and obtain information as well as seek an appropriate prosecution. Prosecutors cannot prosecute offenders according to the Shinkoku-zai (offense prosecuted only upon a criminal complaint) without the Kokuso. Therefore, the Kokuso is a victim's right to stop prosecution, and thus stop investigation. Provisions of the Shinkoku-zai have purposes of settlement according to communities and/or parties. Moreover, the provision of the Shufuku (surrender him/herself to a person with the right to make the complaint), which is applied to all Shinkoku-zai, provides an opportunity for a restoration and apology. Considering these purposes, the Shinkoku-zai is considered as having a background in Restorative Justice.

    This research proposes a new approach to conceiving the relationship between victims and criminal justice processes. In the early Meiji Era (1868–1890), the Kokuso (criminal complaint; Strafantrag) functioned similar to complaints processed according to civil procedure. The Kokuso assumed a purely public function. However, the Kokuso can be considered a victim’s right to seek an appropriate investigation and obtain information as well as seek an appropriate prosecution. Prosecutors cannot prosecute offenders according to the Shinkoku-zai (offense prosecuted only upon a criminal complaint; Antragsdelikt) without the Kokuso. Therefore, the Kokuso is a victim’s right to stop prosecution, and thus stop investigation. Provisions of the Shinkoku-zai (in particular, the special provision for theft committed against relatives and minor crimes of damage to property) have purposes of settlement according to communities and/or parties. Moreover, the provision of the Shufuku (surrender him/herself to a person with the right to make the complaint), which is applied to all Shinkoku-zai, provides an opportunity for a restoration and apology. Considering these purposes, the Shinkoku-zai is considered as having a background in Restorative Justice.

    This study reviews ideal relationships of victims and criminal justice processes from a perspective of "Kokuso"(criminal complaint) and "Shinkoku-zai"(offence prosecuted only upon a criminal complaint). They are the systems that intend to respect intentions of victims. Therefore, under current criminal policy that emphasizes on victims, Kokuso and Shinkoku-zai should be received a lot of attention. This study reviews 1) ideal responses of police officers and prosecutors to victims of Shinkoku-zai, 2) abuses of the right of Kokuso and legal responses to them, 3) the system of Kokuso of agency in fact and the philosophy of victim support, among others, in comparative and historical jurisprudence perspectives.
