2019年6月16日に石川幹人明治大学教授をお招きしての研究会（「心の科学の学際的展開の現状と展望」）を明治大学で開催したのを皮切りに、オンライン会議室(Chatwork)を交えての意見・情報交換を継続的に行ってきた。2019年度末に新型コロナウイルスの感染拡大が始まり対面での交流がほぼ不可能になったことから、オンライン会議室でのコミュニケーション中心に移行した。2020年3月に予定していた対面での研究会合は延期し、オンライン会議室での議論を継続した上で、2020年12月20日にZOOMによる会議を行った。
これらのやり取りを通じて、ネット空間を舞台とする私人間の相互監視と分散的制裁という現代的現象について、代表的事例の質的考察と法的論点の整理を行った。理論的考察の総括として尾崎が「相互監視と分散的制裁」と題する論文を執筆したほか、デジタル社会における人権の問題（山本）や警察権（米田）に関する論考などを公刊することができた。
2019年に現地ヒアリングを行うべく中国社会科学院と連絡をとっていたところ、同時期に発生した複数の研究者の拘束事案を踏まえて、中国側の研究協力者と協議の上で訪問調査を中止し、別の調査国を選定することにした。オーストラリアと台湾を候補に挙げ、それぞれ予備的な訪問調査を2019年度末に行うべく準備していたところ、新型コロナウイルスの急速な感染拡大の深刻化と、世界的な移動の自粛および渡航制限レベルの引き上げを受けて、オーストラリアの予備調査については関係者の協力の下、オンラインでの会議とチャット・システムに切り替えて実施し所期の目的を達成することが出来た。2020年度も同様に新型コロナウイルス感染症拡大の影響による延期（2021年度への事故繰越）をせざるを得なかったため、関連文献の収集により、理論的分析と調査準備を行った。 -

The purpose of this study is: 1) to explore differences between the U.S.and Japanese in use of surveys to prove consumer recognition in trademark litigation and 2) to suggest practical methods of conducting trademark surveys which accord with the Japanese trademark system.
For purpose 1) we surveyed the members of the Japan Trademark Association to clarify national differences in the use of consumer surveys in trademark litigation between U.S. and Japan. These differences had not previously been comparatively and empirically examined.
For purpose 2), we developed standard techniques and questionnaires suitable for the Japanese system which have subsequently made hands-on contributions in several actual trademark disputes. -

We have achieved almost all the goals proposed at the beginning of this study. We were lucky enough to obtain documents of false accusation cases which were offered by the defense counsel. We first analyzed them linguistically, conducted psychological experiments concerning utterance patters observed in those cases, and then examined the result and a proposal from a legal viewpoint. There are a few expressions that DO appear in the criminal investigation process but disappear when recorded on the documents. We focused on speech acts and sentence-ending particles which would help us determine what the accused would have wanted to express and what they would have thought to examine whether they really were trying to confess. The results were reported in many domestic and international conferences.

We carried out empirical researches on cultural confrontations in courtrooms in Japan, Taiwan, and Belgium. With the world being globalized rapidly, foreign travelers and immigrants have come to appear more frequently in a courtroom as defendants, accused or witnesses. We analyzed what cultural differences among the actors (especially legal professions and accused foreigners) impinge on the legitimacy of the judiciary and legal system as a whole.
What we found is (1) most legal professions are unconscious and insensitive about the cultural confrontations in a courtroom because they only look to legal frameworks that absorb and reduce complex matters stemming from cultural differences into the legalistic formulae, and (2) the cultural confrontations are, therefore, repressed and made invisible which contribute cyclically to the unconsciousness and insensitivity of the judiciary. -

This research linguistically analysed language use in legal contexts and explored the possible contribution of linguistics in legal fields. In particular, we examined through linguistic analysis controversial Japanese cases that were prosecuted as threats. As the linguistic analysis matches the conclusions of the judgments, it illustrates how linguistic analysis may help courts to solidify the objective bases of their judgments involving an utterance alleged as a threat.
I also analyzed judicial interpretations in which the defendant’s ‘non-apologies’ and ‘semi-apologies’ were translated as apologies to show the necessity of achieving equivalence in translating such delicate expressions involving elements of apology. -

The purposes of this study were to establish methods to analyze linguistic aspects of trademarks and to find ways to apply them to legal practice. Among the phenomena concerning trademarks, genericide and dilution were focused on and event related potentials (ERP) of marks undergoing those phenomena were measured. Some distinctive features were discovered concerning each of the phenomena in terms of ERP. We believe the results would have some implications for the practical application of those analyses.

Equating, used in TOEFL or TOEIC, makes it possible to compare different set of testing. Test theory studies this field of measuring test score. This study, from the perspective of test theory, had equated different sets of law tests to examine if the validity of the equated scores. Law test usually is administered as a “qualifying” test, but in most cases it is indeed a “competitive” one. This study is a basic study for making law test more “qualifying” test as it is supposed to be.

We attempted to construct a theoretical model that can explain the inter-relationship between cognitive processes and particular language use in the context of interpersonal relations including the process of cultural adaptation and conflict resolution. In order to test some of the propositions in the model, a series of empirical studies were conducted, mainly on the basis of experimental methods. We also revealed the role of culture as a basis for cognition and linguistic acts. Symposia and workshops were organize at different conferences to present the findings.

In order to deal with the issues concerning bias from camera-perspective on the video-recording of suspect interview, visualization by three-dimension tool, "KTH cube", presentation of confession statements in court, bias from pre-trial publicity on a crime report by the media and linguistic characteristics of the deliberations between lay judges and professional judges, the inter-disciplinary approach was applied. This approach, composed by the field of law, psychology, linguistics and information technology, was proved to be useful in the attempt to suggest some solutions to the problems above.

Our research project conducted two questionnaire surveys among ordinary people in Japan, in order to research the Japanese attitudes toward criminal justice and those toward the lay judge system.
The knowledge we acquired from these surveys is as follows. (1)Ordinary people generally take severer attitudes toward suspects or defendants. (2)They highly evaluate the lay judge system with respect to understandability and democracy, while the evaluation of finding the truth is rather negative. (3)They are not very willing to serve as lay judge in general, however, the self-directive people with higher educational background and high-income, who are less dependent on the others or the government, are more willing. (4)Positive evaluations of the lay judge system were observed more in the second survey than the first survey. -

The monitor corpus of the Japanese English textbooks created so far was updated and expanded and the English textbooks used in the Asian countries were added to examine quantitatively and qualitatively what was lacking in the Japanese system, especially with regard to vocabulary, structures, grammatical items, topics, and socio-cultural factors.
The international symposia and a series of public lectures and workshops were also held to find the future direction of the English education in Japan by examining the current state of English education in Japan and Asian countries and the problems they face, sharing the new findings in the field of Englishteaching and English studies together with the methodologies of dealing with the corpus data. A report covering them was published in the final stage. -

本研究の目的は以下i〜ivの4つであった。
i.国外での言語科学の裁判過程への応用状況を詳細に検討することにより、国民の期待に応える司法制度の「専門的知見を要する事件への対応強化」の言語学からの実践として、具体的に応用が可能な法分野、裁判過程や証拠の種類、および分析手法モデルの発展・確立を目指す。
ii.日本の裁判過程での言語科学の利用・発展を妨げている要因を特定し、実現可能な解決策を提言する。
iii.言語と法は共にシステムであるという観点から、言語学で利用されているシステム分析の諸理論の法システムの分析への応用可能性を追求する。
iv.法言語学の研究成果を、法学教育や専門英語教育に還元する方法を模索する。
研究成果について、上記i〜ivに照らして述べる。(i)に関しては、複数回にわたる海外調査、学会参加(発表を含む)を含めて調査を行い、法言語学の応用の分野として商標の識別力および稀釈化の分析モデルを開発した。また、同時に全国で行われている法曹三者による模擬裁判における評議における裁判官と裁判員のコミュニケーションを、発話量や論拠などの観点から分析するモデルを開発した。その成果は、堀田(2007等)に発表済みで、関係各所から比較的高い評価を受けている。
(ii)に関しては、言語学の研究対象や研究方法と科学性を検証し、ことばに関する証拠の分析・鑑定の手段として言語科学を利用する際に立ちはだかる障害を、Thomas Kuhnのパラダイム論を有標性(markedness)という観点から捉え直したMcCawley(1985)の理論を援用して考察した。研究結果は、堀田(2006a)にて公表済み。
(iii)に関しては、現在、単独の成果としての論文こそないが、筆者の裁判員制度研究の骨子となっている部分として、他の研究成果に活かされているものである。

The project has investigated how museum and museum professionals of negative heritage are committed to educational programs that promote the conservation, continuation and communication to society of the world's natural and cultural heritage, present and future, tangible and intangible. The project focuses on the analyses of how practitioners are working closely with community and political leaders, local governments and international organizations. The main target sites are cities that were once brought to complete destruction by the dropping of atomic bomb or air raids during the war : From Dresden, Berlin, Hiroshima to Tokyo. The study is based on field research and interviewing practitioners and policy makers who are involved in preserving the historic sites. These include members of the International Committee of Memorial Museums for the Remembrance of Victims of Public Crimes and the International Coalition of Historic Site Museum of Conscience.

本助成期間中に、行ったことを以下に簡単にまとめる。
□法言語学の海外での動向に関する調査を行った。その成果の一部は堀田(2003)で公表済み。
□判例を題材として被験者を用いて商標の混同を調査し、その結果を基に、国内外で初の認知的アプローチと言語学を融合した独自の商標の言語分析モデルを構築した。成果の一部は堀田(2004)にて公表済み。また、これを言語学関係の学会誌や紀要ではなく、立命館法学に掲載することで、法学系の読者層の目に留まるようにした。
□言語分析を裁判で用いるためには、何よりもまずその必要性と有用性が明らかにされなければならない。専門家がなぜ裁判に必要なのかを論じるために、一般人の持つ言語構造に関する知識と言語学者が認識する言語構造には差がある例を調査した。成果の一部は堀田(2005)として公表が決定している。
□言語科学を裁判に用いるにはその科学性が認識されなければならない。その科学性をJames McCawley(1986)のThomas Kuhnのパラダイム理論を有標・無標というから捉えなおしたアプローチを利用して分析を行った。成果に関しては、現在、「言語科学の科学性」というテーマで、論文を法社会学会の学会誌への投稿の準備している。(大河原等との共著in preparation)
□立命館大学土曜講座で一度、立命館大学言語文化研究所主催の言語理論研究会で二度ほど「裁判と言語」に関するテーマで講演、研究発表を行った。 -
